ABSTRACT

Os autores apresentam a evolução histórica dos caminhos percorridos até a criação do primeiro programa público de interrupção legal da gestação no Brasil. Mencionam o atendimento antes desse programa, que era realizado por poucos, de maneira dissimulada e sem publicidade nem publicações para a preservação das equipes. Mencionam como o Hospital Municipal Dr. Arthur Ribeiro de Saboya foi escolhido para esse desafio. Resgatam a luta das mulheres e dos movimentos feministas, e a criação da portaria que determinava a obrigatoriedade do atendimento para a realização do abortamento legal nos casos de antijuricidade, pela Prefeitura Municipal de São Paulo. Mencionam os difíceis caminhos até a constituição das equipes de atendimento e o desenrolar de uma sequência de fatos históricos, passando pelo início do atendimento imediato às vítimas no sentido de realizar as profilaxias pertinentes, a utilização de aspiração manual intrauterina (AMIU) como técnica principal para atendimento ao abortamento em todas as suas situações, os Fóruns Nacionais de Aborto Legal realizados pelo Cemicamp, Ministério da Saúde e Federação Brasileira das Associações de Ginecologia e Obstetrícia (Febrasgo), entre outros, que culminaram com tudo o que temos hoje em termos de atendimento integral à saúde da mulher, mormente no que tange aos direitos sexuais e reprodutivos, à violência sexual e à interrupção legal da gestação.(AU)


The authors present the historical evolution of the paths traveled until the creation of the First Public Program for Legal Interruption of Pregnancy in Brazil. They mention the care before this program that was carried out by a few, in a covert way and without advertisements or publications for the preservation of the team. Mention as the Municipal Hospital Dr. Arthur Ribeiro de Saboya was chosen for this challenge. They rescued the struggle of women and feminist movements, the creation of the ordinance that determined the mandatory care for the performance of legal abortion in cases of anti-juristy, by the city of São Paulo. They mention the difficult paths to the constitution of care teams and the development of a sequence of historical facts, through the beginning of immediate care to victims in order to perform the relevant prophylaxis, in the use of the AMIU as the main technique for abortion care in all its situations, the National Legal Abortion Forums held by Cemicamp, Ministry of Health and Federação Brasileira das Associações de Ginecologia e Obstetrícia (Febrasgo), among others, which culminated in all that we have today in terms of comprehensive care for women's health, especially with regard to sexual and reproductive rights, sexual violence and legal interruption of pregnancy.(AU)

La autora de este artículo hace una síntesis de la evolución histórica y de las diferentes posturas religiosas frente al abor-to, describe su epidemiología mundial y la posición de la Organización Mundial de la Salud frente a esta problemática, resume el desarrollo y el desenlace del recientemente instalado debate sobre la legalización del aborto en Argentina y, finalmente reflexiona sobre lo que nos ha dejado este proceso político. The author of this article summarizes the historical evolution and the different religious positions regarding abortion, describes its global epidemiology and the position of the World Health Organization in relation to this problem, summarizes the development and the outcome of the recently installed debate on the legalization of abortion in Argentina and, finally, reflect on what this politi-cal process has left us. ABSTRACT

Presenta una abordagen sobre o aborto realizado de modo regular que se efetuaban en los hospitales públicos. Las estatísticas médicas del servicio de salud de la Universidad de Chile documentan que el personal médico atendió 1566 partos e 663 abortos en 1931, y 1481 partos y 591 abortos en 1932, pero no se entregan mayores detalles sobre los embarazos abortados. En 1936, los médicos plantearon el problema de la mortalidad materna y del aborto en un Congreso Médico en Valparaíso.

ABSTRACT

O aborto induzido tem sido discutido no Brasil por muitos anos sem produzir mudanças no Código Penal, em vigor desde 1940, de acordo com o qual ele é ilegal e um crime contra a vida. Há apenas duas circunstâncias nas quais a lei brasileira permite a interrupção de gestações: quando ela resulta de estupro ou se não há outro meio de salvar a vida da mulher. Desde 1989, entretanto, tem se multiplicado o número de autorizações judiciais permitindo abortos nas gestações em que existem anormalidades fetais incompatíveis com a vida. O aumento destas decisões judiciais tem criado um corpo de jurisprudência que pode levar a futuras mudanças no Código Penal. Uma liminar de um ministro do Supremo Tribunal Federal, Marco Aurélio Mello, em julho de 2004, permitiu, temporariamente, o aborto em casos de anencefalia. O pleno desta Corte, em outubro de 2004, cassou esta liminar, ficando o problema para ser resolvido posteriormente, através de uma sentença definitiva deste mesmo tribunal. Desde 1971, tem ocorrido um debate legislativo no Congresso Nacional, focalizando mudanças no Código Penal, no que diz respeito à lei do aborto. Considerando o papel exercido por organizações feministas, fazendo pressão social no congresso e no executivo, o governo brasileiro criou uma comissão para propor mudanças nas leis e políticas para o aborto. O objetivo deste artigo é debater como o problema do aborto tem sido tratado no Brasil.

ABSTRACT

The essay discusses abortion in Puerto Rico from 1937 to 1970, concentrating in its legal status as well as its social practice. The research documents the contradictions between the legality of the procedure and a social practice characterized by secrecy. The essay discusses the role of the Clergy Consultation Service on Abortion in promoting the legal practice of absortion in Puerto Rico. It also discusses the ambivalent role of medical doctors who, despite being legally authorized to perform abortions to protect the life and health of women, refused to perform the procedure arguing abortion was illegal. The essay concludes with a brief discussion on perceptions of illegality regarding abortion, emphasizing the contradictions between the practice of abortion and that of sterilization in Puerto Rico

ABSTRACT

This paper situates the current abortion practice and policy in Puerto Rico within the historical, political, and economic context of the colonial domination of the United States (US) over Puerto Rico. In particular, we pay attention to the hurdles that women face to obtain abortion services in Puerto Rico as a result of its colonial legality. Of particular significance is the overall low abortion ratio, and differential abortion ratio and access issues faced by women when grouped by an age-ethnicity category: unmarried teenagers, adult Puerto Rican women and, adult immigrant women from the Dominican Republic. The present hurdles to abortion access--related to information, abortion providers, economic situation, and government policies--are discussed within the colonial legality of abortion based on the US Supreme Court decision Roe v. Wade. Puerto Rico's case is situated within its broader history of population policies developed by the State since the 1930's. Of particular relevance is the antagonism that State managers have had towards abortion in spite of its legality. In this sense, abortion in Puerto Rico continues to be an unfinished business, in spite of its legality
